These Terms & Conditions apply to all bookings for Elie Beach Apartment, located at Apartment 3 Hycroft, Lodge Walk, Elie, KY9 1EE. By making a booking, the guest agrees to these Terms & Conditions.
1. Booking and Payment
1.1 A booking is only confirmed once the required deposit or full payment has been received and written confirmation has been issued by the owner or property manager.
1.2 The total rental price, payment schedule, and any additional charges will be confirmed at the time of booking.
1.3 Full payment must be received no later than 10 days before the arrival date, unless otherwise agreed in writing.
1.4 If payment is not received by the due date, the owner reserves the right to cancel the booking and retain any sums already paid, subject to the cancellation terms below.
2. Security Deposit
2.1 A refundable security deposit of £50 may be required before check-in.
2.2 The security deposit may be used to cover loss, breakage, damage, missing items, extra cleaning, or any breach of these Terms & Conditions.
2.3 Any balance due for return will be refunded within 7 days after departure, subject to inspection of the property.
3. Cancellation and Refunds
3.1 All cancellations must be made in writing by email to Bookings@eliebeachapartment.co.uk
3.2 If the guest cancels the booking:
- more than 30 days before arrival, the guest will receive a full refund of any monies paid, less a £30 administration fee
- between 15 and 30 days before arrival, the guest will receive a 50% refund of the total booking price
- less than 15 days before arrival, no refund will be payable
3.3 If the owner cancels the booking due to circumstances beyond the guest’s control, the guest will receive a full refund of all monies paid for the booking. The owner’s liability will be limited to the total amount paid by the guest for the stay.
3.4 No refund will be given for early departure, no-shows, or a reduction in the length of stay unless agreed in writing by the owner.
3.5 Guests are strongly advised to take out suitable holiday and travel insurance to cover cancellations, accidents, loss, or other unforeseen circumstances.
4. Check-in and Check-out
4.1 Check-in is from 3.00pm. on the day of arrival.
4.2 Check-out is by 11.00am on the day of departure.
4.3 Early check-in or late check-out may only be available by prior agreement and may incur an additional charge.
5. Occupancy
5.1 The maximum number of guests permitted to stay at the property is 4.
5.2 Only those guests named on the booking may stay at the property unless prior written permission has been given by the owner.
5.3 The owner reserves the right to refuse entry or terminate the booking without refund if the maximum occupancy is exceeded or if the booking information provided is materially inaccurate.
6. Guest Responsibilities
6.1 Guests must keep the apartment, furniture, fixtures, fittings, and contents in a clean, tidy, and good condition throughout the stay.
6.2 Guests must behave responsibly and with consideration for neighbours and the local community.
6.3 No parties, events, stag or hen gatherings, or other large social gatherings are permitted without prior written consent.
6.4 Quiet hours apply between 8.00pm and 8.00am.
6.5 Guests must ensure that the property is left locked and secure whenever it is unoccupied.
6.6 Keys, access devices, and any equipment provided must be kept safe and returned as instructed at the end of the stay. Charges may apply for lost keys or replacement locks where required.
7. Children and Safety
7.1 Children must be supervised by a responsible adult at all times.
7.2 Guests are responsible for deciding whether the property is suitable for infants and children in their party.
7.3 The owner accepts no responsibility for accidents, injuries, or losses arising from failure to supervise children or use the property safely.
8. Pets
8.1 Pets are not permitted
8.2 Where pets are permitted, guests must ensure that pets are properly supervised, do not cause damage, and do not create nuisance for neighbours or other residents.
8.3 Guests remain fully responsible for any damage, fouling, or additional cleaning arising from pets.
8.4 Assistance dogs will be permitted in accordance with applicable law.
9. Smoking and Vaping
9.1 The property is strictly non-smoking and non-vaping unless expressly stated otherwise in writing.
9.2 If guests smoke or vape within the property in breach of this condition, the owner may charge for specialist cleaning, deodorising, and any related damage.
10. Damage, Breakages, and Cleaning
10.1 Guests must report any damage, breakage, accident, or maintenance issue as soon as reasonably possible.
10.2 Guests are responsible for any damage caused by themselves or any member of their party, other than fair wear and tear.
10.3 The property must be left in a reasonably clean and tidy condition on departure. The owner reserves the right to charge for additional cleaning where the property is left in an unreasonable condition.
11. Use of the Property
11.1 The property must be used solely for holiday accommodation and must not be used for any business purpose, unlawful activity, or antisocial behaviour.
11.2 The property must not be sublet or assigned to any other person without the owner’s prior written consent.
11.3 Guests must comply with any instructions provided in the welcome information or house manual.
12. Utilities, Wi-Fi, and Maintenance
12.1 The rental charge includes reasonable use of utilities and amenities unless otherwise stated.
12.2 While every effort is made to ensure that services and appliances, including heating, hot water, internet access, and electrical equipment, are available and in working order, the owner cannot guarantee against interruption caused by repair, maintenance, failure of supply, or any circumstance beyond their reasonable control.
12.3 No refund or compensation shall be payable for temporary failure or interruption of services outside the owner’s reasonable control.
12.4 The owner or their representative may enter the property at reasonable times for inspection, maintenance, repairs, or in an emergency.
13. Lost Property
13.1 Any personal belongings left behind after departure may be retained for 7 days.
13.2 Where requested, lost property may be returned to the guest at the guest’s cost and risk.
13.3 The owner accepts no responsibility for items left behind at the property.
14. Right to Refuse or Terminate a Stay
14.1 The owner reserves the right to refuse a booking or terminate a stay without refund where a guest:
- commits a serious breach of these Terms & Conditions
- causes damage, nuisance, disturbance, or abusive behaviour
- uses the property for any unlawful purpose
- provides false, misleading, or incomplete booking information
14.2 In such circumstances, the guest and all members of their party may be required to leave the property immediately.
15. Liability
15.1 Guests occupy and use the property entirely at their own risk.
15.2 Nothing in these Terms & Conditions is intended to exclude or limit liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
15.3 Subject to clause 15.2, the owner shall not be liable for:
- any loss, theft, or damage to guests’ personal belongings
- any injury, loss, accident, delay, or inconvenience arising from the guest’s use of the property
- any temporary outage or failure of utilities, internet, appliances, or local services
- any matter outside the owner’s reasonable control, including severe weather, travel disruption, government action, or force majeure events
15.4 Subject to clause 15.2, the owner’s total liability arising out of or in connection with the booking shall not exceed the total amount paid by the guest for the stay.
16. Complaints
16.1 If a guest has any complaint during their stay, they must notify the owner or property manager as soon as possible to allow a reasonable opportunity to resolve the matter.
16.2 Complaints first raised only after departure may restrict the owner’s ability to investigate and address the issue.
17. Privacy and Personal Data
17.1 Personal information supplied by guests will be used for the purposes of administering the booking, communicating with guests, complying with legal obligations, and protecting the legitimate interests of the owner.
17.2 Personal data will be handled in accordance with applicable UK data protection legislation, including the UK General Data Protection Regulation and the Data Protection Act 2018.
17.3 Personal information will not be shared with third parties except where reasonably necessary for managing the booking, providing services, complying with legal obligations, or protecting legal rights.
18. Governing Law and Jurisdiction
18.1 These Terms & Conditions and any dispute or claim arising out of or in connection with them or any booking shall be governed by and construed in accordance with the laws of Scotland.
18.2 The courts of Scotland shall have exclusive jurisdiction over any dispute or claim arising in connection with these Terms & Conditions or any booking.
